ACFA Membership Terms & Conditions

1. Membership Term

1.1 Membership with ACFA (KBDi) is granted for a fixed term of twelve (12) months from the date of acceptance or renewal.

1.2 Membership is not provided on a month-to-month basis.

1.3 Membership entitlements are provided in consideration of:
• Payment of applicable membership fees; and
• Ongoing compliance with these Terms and all ACFA (KBDi) policies, rules and codes.

 

2. Membership Categories and Entitlements

2.1 Membership categories, classifications and entitlements under ACFA (KBDi) may be determined and varied by ACFA from time to time in accordance with the ACFA Constitution.

2.2 Membership entitlements apply only while membership remains current and financial.

 

3. Membership Fees and Financial Year Review

3.1 Membership fees for ACFA (KBDi) are set annually by ACFA.

3.2 ACFA reserves the right to review and amend membership fees at the commencement of each Financial Year (1 July).

3.3 Fee adjustments may apply to:
• Annual payments; and
• Instalment payment arrangements.

3.4 Members will be given reasonable notice of any fee changes.

3.5 Continued membership after notification constitutes acceptance of revised fees.

 

4. Payment Obligations

4.1 Membership fees for ACFA (KBDi) must be paid:
• In full annually; or
• Via an approved payment plan.

4.2 Failure to pay may result in:
• Suspension of benefits; and/or
• Termination of membership.

4.3 All fees are payable regardless of usage of services.

 

5. Monthly Payment Plans and Auto Renewal

5.1 Where payment by instalment is approved:
• Payments will be processed via a nominated debit or credit facility;
• Instalments will be spread over twelve (12) payments unless otherwise approved.

5.2 A processing fee may apply to payment plans.

5.3 Declined payments may incur a failed payment fee.

5.4 If three (3) instalment payments fail:
• The payment plan may be cancelled; and
• The full outstanding balance becomes immediately payable.

5.5 Members who resign or whose membership is terminated remain liable for the full annual membership fee.

5.6 Automatic Renewal (Direct Debit Members)

Where a Member elects to pay their ACFA (KBDi) membership via a monthly direct debit arrangement, membership will automatically renew for a further twelve (12) month term unless the Member provides written notice of non-renewal at least thirty (30) days prior to the end of the current membership term.

If notice is not provided within this timeframe, the membership will renew and the Member will be liable for the full membership fees for the new term.

 

6. Membership Renewal, Lapse and Termination

6.1 Members will be invited to renew their ACFA (KBDi) membership prior to expiry.
6.2 Memberships that remain unpaid for thirty (30) days may be suspended.

6.3 Resignation

Members may resign their ACFA (KBDi) membership at any time by providing written notice to ACFA.

Resignation will take effect in accordance with the ACFA Constitution.

Notwithstanding resignation, membership is for a fixed 12-month term and Members remain liable for all membership fees and charges for the full membership term. No refunds will be provided except where required under Australian Consumer Law.

6.4 Suspension and Termination

ACFA may suspend or terminate ACFA (KBDi) membership for:
• Breach of these Terms;
• Breach of any Code of Ethics or Code of Conduct; or
• Conduct considered detrimental to ACFA (KBDi) or its Members.

Any suspension or termination of membership will be carried out in accordance with the ACFA Constitution, including the application of procedural fairness and any applicable rights of appeal.

 

7. Use of Branding, Logos and Post Nominals

7.1 ACFA (KBDi) branding may only be used while membership is current.

7.2 Upon cessation, Members must immediately:
• Remove all ACFA (KBDi) branding and signage;
• Remove references from websites and materials;
• Cease use of post nominals;
• Cease use of member-only documents and resources.

7.3 Continued use after cessation is unauthorised.

 

8. Fair Use of Information and Advice

8.1 Information and advice provided by ACFA (KBDi) is for Member use only.

8.2 Members must not:
• Use information for resale or commercial distribution;
• Provide materials to third parties;
• Use services for external benefit.

8.3 Breach may result in suspension or termination.

 

9. Refund Policy

9.1 Membership fees for ACFA (KBDi) are strictly non-refundable, subject to Australian Consumer Law.

9.2 This includes:
• Application fees;
• Annual fees;
• Instalment payments;
• Processing fees;
• Failed payment fees.

9.3 No refund will be issued for resignation, termination, suspension, or partial membership periods, except where required under Australian Consumer Law.

 

10. Voting Rights

10.1 Only financial Members are entitled to vote.

10.2 Student and Associate Members do not have voting rights.

10.3 Voting rights are suspended if a Member becomes unfinancial.

 

11. Advice and Disclaimer

11.1 ACFA (KBDi) is not a legal, financial or professional service provider.

11.2 Information provided is general in nature and should not be relied upon as a substitute for independent advice.

11.3 To the fullest extent permitted by law, ACFA (KBDi) disclaims all liability arising from reliance on information provided.

 

12. Privacy

12.1 Personal information is collected to:
• Administer membership;
• Deliver services and benefits;
• Communicate industry information and opportunities.

12.2 Information may be shared with related entities and approved service providers.

12.3 ACFA (KBDi)’s Privacy Policy is available on its website.

 

13. Membership Services and Variations

13.1 Membership services and benefits are those available at the time of delivery.

13.2 ACFA may vary, suspend or withdraw ACFA (KBDi) membership services and benefits from time to time. Where any change materially impacts the overall value of membership, ACFA will provide reasonable notice to Members.

13.3 Membership entitlements are personal and non-transferable unless approved.

 

14. Business, Designer and Corporate Memberships

14.1 A company or business may elect to hold a KBDi Business Membership where multiple staff intend to participate.

14.2 A Business Membership allows two or more designers within the same business to become Members at a reduced rate. Each individual Member must complete a personal membership application and will be entitled to the benefits and privileges applicable to their respective membership category.

14.3 Where a Member covered under a Business Membership ceases employment with the business, the nominated business representative may transfer that membership to another eligible designer within the same business. A maximum of three (3) transfers per membership term is permitted.

 

15. Social Media and Online Platforms

Members must not:
• Post unauthorised advertising;
• Infringe intellectual property;
• Post unlawful or offensive content;
• Misrepresent affiliation.

ACFA (KBDi) may suspend or remove access for breaches.

 

16. Dispute Resolution

Any disputes relating to ACFA (KBDi) membership will be managed and resolved in accordance with the ACFA Constitution.

 

17. Governing Law

These Terms are governed by the laws of Australia.

 

18. Interpretation + Definitions

12.1    Personal pronouns:  Except where the context otherwise provides or requires:

12.1.1 the terms weus or our refers to ACFA; and

12.1.2 the terms you or your refers to Member.

12.2    Defined terms: In this document, unless otherwise provided, the following terms shall have their meaning as specified:

ACFA means the Australian Cabinet and Furniture Association (ACN 000 071 787).

Member means a person or entity that has agreed to become a member of ACFA and be bound by this document and the ACFA Constitution.

Business NSW means the NSW Business Chamber Limited, trading name ‘Business NSW’(ACN 000 014 504).
