ACFA Membership Terms & Conditions

1. Membership Services

1.1  Membership services and benefits will be supplied by us and our affiliates, including Business NSW.

1.2  ACFA provides Members with a range of information and service as part of its membership, including but not limited to: HR Advice/Information, Award Interpretation, WHS Induction tool, Dedicated HR Hotline, Work Health and Safety Information and Access to a complete advisory service.

1.3  The provision of such information is at all times at the absolute discretion of ACFA and is subject to change, variation or cancellation at any time.

1.4  Details of ACFA’s membership packages and the services and benefits offered by ACFA are provided on our Website.

2. Specialist Services

2.1 Supplemental, specialist and customised products may also be made available, on a fee for service basis, at special rates for Members in most cases. Such products may include but are not limited to: Seminars, Workshops, Training Courses, Specialised Services.

3. Fees + Membership Renewal

3.1 Membership is provided on an annual subscription basis and will continue provided that your membership fees are not in arrears. Membership fees will be reviewed annually and may be subject to increase at our discretion.  We will notify you of any change to your annual membership fee in accordance with the Constitution.

3.2 We may cancel any membership where membership fees are in arrears. In this circumstance, we reserve the right to:

3.2.1  recover the monetary benefit of any membership discounts(s) received by you whilst you were in arrears; and

3.2.2  withdraw the benefit of the membership discount if payment for services received and/or products supplied are not paid in full within 30 days of receipt of the invoice.

3.3 Prior to the renewal date for your membership a membership renewal reminder will be emailed to you each year to the email address provided to us or if requested or at the discretion of ACFA or if no email address provided a tax invoice will be posted to the last address you provided to us.

3.4 We offer payment of your annual membership fee via direct debit arrangement, credit card or cheque.  Membership fees which can be paid yearly or monthly in advance. If you pay monthly, then the number of payments is twelve (12) payments per annum. An administration fee will be charged for monthly payments.

3.5 Should you elect to pay your annual membership subscription via monthly direct debit, your membership will be renewed automatically unless your membership is cancelled by you by written notice to us at least (30) days prior to the beginning of your new membership term.

4. Membership verification/validation

4.1 Upon receipt of the membership payment you are recorded as a Member of ACFA.

4.2 All Members are issued with a username and membership number.

4.3 Only financial Members are able to access the Member services such as the Business NSW Hotline and the Members Only Section of the Website.

4.4 A password will need to be created by the member by accessing our member login on the Website and clicking lost password and entering your email address to have your password updated.

4.5 You should keep your password secure and not disclose it to anyone.  In circumstances where you cannot remember your membership number, you can:

4.5.1 contact our office on 1300 342 248 and they will be able to assist you; or

4.5.2 click lost password when logging onto the Website and a link will be emailed to you to re-set your password.

4.6 If any of your details change, such as your address, telephone number you must inform us as soon as possible since changes may impact upon our ability to deliver your membership services. You can also update your change of details through the website after logging on as a member.

5. Lapsing of membership

5.1 Where a Member’s subscription is overdue, access to membership services and benefits may be denied pending payment of any outstanding subscription or other fees.

5.2 We reserve the right to cancel any membership in accordance with the Constitution where membership fees are in arrears.

6. Termination of membership

6.1 Any Member who abuses, offends or puts at risk any member of the Association’s staff or any contractor in the carrying out of their usual duties may be charged with conduct detrimental to the Association.

6.2 In such cases the Board of Directors has the power to expel the person from membership of the Association. On expulsion from the Association, the Member forfeits all rights and claims on the Association.

7. Fair use of information and advice

7.1 You agree:

7.1.1 that any information or advice we provide to you is for your use only;

7.1.2 not to use the information or advice for commercial resale or gain;

7.1.3 not to provide such information or advice to any third party for the use or benefit of the third party;

7.1.4 not to use your access to our information and advice to obtain information or advice for the use of a third party.

8. Refund policy

8.1 Membership Fees are non-refundable.

9. Voting rights

9.1 Although there are various classes of membership, only financial Members have the right to vote in Board Elections and at meetings of ACFA.

9.2 Student and Associate membership is excluded from voting and does not have the right to vote in Board Elections and at meetings of ACFA.

10. Disclaimer

10.1 We are not a legal service and should not be relied upon in place of specific legal advice.

10.2 To the full extent permitted by law, we and our related entities exclude and disclaim all liability for any loss or damage which may be suffered or incurred by any person, company or organisation arising from reliance on information provided to the recipient.

10.3 We disclaim any liability, loss or risk incurred as a consequence, directly or indirectly, of the use of any of the information or advice given.

11. Privacy Statement

11.1 Your privacy is important to us. Personal information which we collect is used for the purpose of providing you with information about the range of membership services and benefits available. We may also use your personal information to keep you informed of the events and seminars which may be of interest to you and to provide you with promotional and marketing material about our products and services.

11.2 To provide the range of membership services and benefits available to you, we may provide your membership details and information to our related entities and pre-selected service providers. By accepting membership of with us, you consent to this sharing of information.

12. Interpretation + Definitions

12.1    Personal pronouns:  Except where the context otherwise provides or requires:

12.1.1 the terms weus or our refers to ACFA; and

12.1.2 the terms you or your refers to Member.

12.2    Defined terms: In this document, unless otherwise provided, the following terms shall have their meaning as specified:

ACFA means the Australian Cabinet and Furniture Association (ACN 000 071 787).

Member means a person or entity that has agreed to become a member of ACFA and be bound by this document and the ACFA Constitution.

Business NSW means the NSW Business Chamber Limited, trading name ‘Business NSW’(ACN 000 014 504).
